Antitrust
Mr. McDowell began his career defending the most serious antitrust cases, including three MDL cases. He now counsels clients as to their horizon antitrust issues to keep his clients out of litigation and investigations and to zealously represent them in legal battles. He has represented clients in various industries, including, by example, natural gas, healthcare, paper and retail grocery.
Complex Commercial Litigation
Mr. McDowell has tried a broad range of complex commercial cases and facilitated settlement short of trial in many. Those cases have involved many substantive issues. He has represented clients in numerous industries, including, by example, real estate, banking, movie production, food manufacturing, aviation and commercial leasing.
Executive Employment Negotiation
What started out to be representation of friends and family turned into representing individuals who have been wrongfully terminated by their companies. Examples include Mr. McDowell’s negotiating a reinstatement with backpay. In another, Mr. McDowell was able to negotiate a settlement to ensure financial stability in the wrongfully terminated person’s life. These negotiations have taken place, by example, in the airline industry, the banking industry, and the outsourced employee benefits industry.
Intellectual Property
Mr. McDowell has represented plaintiffs and defendants in all aspects of intellectual property litigation and negotiations. He has represented parties in patent litigation across the United States for more than 20 years. He has represented plaintiffs in piracy cases. He has represented plaintiffs and defendants in Copyright, Trademark, Trade Dress and Trade Secret matters. By example, he has represented clients in the hospitality, apparel, smart meter, cell phone, medical device, supplement and prescription drug industries.

Mr. McDowell has given his expert opinion across a wide range of substantive areas and industries, with recent engagements in Intellectual Property matters. Since the beginning of his career, Mr. McDowell has opined on attorney fee applications and reasonable attorney fees and has testified on his opinions in court, via reports and depositions.
